For ATOMIC AUTO SPARE PARTS TRADING LLC – UAE Operations
1. Scope and Definitions
1.1 These GTC apply to all contracts concluded between ATOMIC AUTO SPARE PARTS TRADING LLC (hereinafter "Seller") and a customer (hereinafter "Customer") via the online store for delivery within the United Arab Emirates.
1.2 Consumer: Any natural person purchasing goods for personal use.
1.3 Business Operator: Any natural or legal person purchasing goods for commercial or professional use within the UAE.
1.4 These terms comply with UAE Federal Decree-Law No. 14 of 2023 on Trading by Modern Technological Means.
2. Conclusion of Contract
2.1 Product descriptions in the online store do not constitute binding offers but are invitations to the Customer to submit a binding offer.
2.2 By clicking "Order and Pay", the Customer submits a legally binding offer.
2.3 The contract is concluded only when the Seller sends an Order Confirmation or dispatches the goods.
2.4 Technical steps: The Customer can correct input errors using standard functions before the final click. The contract text will be stored and sent via email.
2.5 Languages: The contract is available in English and Arabic (as per UAE Consumer Protection Law).
3. Right of Withdrawal and Returns
3.1 In accordance with the UAE Consumer Protection Law (Federal Law No. 15 of 2020), the Customer has the right to return goods if they are defective or do not conform to the agreed specifications.
3.2 Change of Mind: We offer a voluntary 7-day return policy provided the item is unassembled, in its original packaging, and in "as-new" condition.
3.3 Hygiene and custom items are excluded from return unless defective.
4. Prices and Payment Terms
4.1 All prices are in UAE Dirhams (AED).
4.2 VAT: Prices are inclusive of 5% VAT as per UAE Federal Law. The Seller’s TRN (Tax Registration Number) will be provided on the final invoice.
4.3 Payment methods: Credit/Debit Cards (processed via secure UAE-compliant gateways), Apple Pay, and Cash on Delivery (COD) (subject to limits).
4.4 In case of default, the Seller reserves the right to charge administrative fees as permitted by UAE regulations.
5. Delivery and Shipping
5.1 Delivery is limited to the territory of the United Arab Emirates.
5.2 Delivery times: Standard delivery is 2-5 business days. Remote areas (Western Region) may require additional time and surcharges.
5.3 If a product is permanently unavailable, the Seller will inform the Customer immediately and refund any payments made.
5.4 Proof of Delivery: A signature and/or presentation of a valid Emirates ID may be required upon receipt.
6. Retention of Title
The goods remain the property of the Seller until full payment of the purchase price is received.
7. Warranty and Liability for Defects
7.1 All goods are covered by a minimum 1-year statutory warranty against manufacturing defects as per UAE law.
7.2 Premium models may carry an Extended 2-year warranty (as specified on the product page).
7.3 The warranty does not cover: Normal wear and tear, misuse, or damage caused by the harsh climate (direct sunlight exposure) if care instructions were ignored.
7.4 If a defect is found, the Customer is entitled to Repair, Replacement, or Refund, prioritized according to the nature of the defect.
8. Liability
8.1 The Seller shall be liable for damages resulting from intent or gross negligence.
8.2 Liability for minor negligence is limited to foreseeable damages typical for the contract. 8.3 Nothing in these GTC excludes liability for death or personal injury caused by negligence.
9. Data Protection
9.1 Customer data is processed in compliance with UAE Federal Decree-Law No. 45 of 2021 (Personal Data Protection Law).
9.2 Data is used only for order fulfillment and authorized marketing (Opt-in).
10. Applicable Law and Jurisdiction
10.1 These GTC are governed exclusively by the Federal Laws of the United Arab Emirates and the local laws of the Emirate of [Dubai/Abu Dhabi].
10.2 The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
10.3 Any dispute shall be subject to the exclusive jurisdiction of the [Dubai/Abu Dhabi] Courts.
11. Alternative Dispute Resolution
11.1 For complaints, Customers may contact the Ministry of Economy Consumer Protection Department (Call Center: 600 522 225) or the local Department of Economy and Tourism (DET).
